"Thalyra" is a brand of CuraCap Schweiz GmbH.
1. Scope and parties
These General Terms and Conditions exclusively govern the business relationship between CuraCap Schweiz GmbH (the "Provider") and the buyer ("you"), in the version applicable at the time of purchase.
A consumer within the meaning of these terms is any natural person who enters into a transaction for purposes that are predominantly outside their trade, business, craft, or profession. Terms deviating from these AGB are not recognised unless the Provider expressly agrees to them in writing.
2. Subject matter
Thalyra is a platform for digital online mini-courses across several brands of the CuraCap group (including FACE-Methode®, YourFaceDesigner, CuraCap, Health Chemist). By purchasing, you acquire one-time access (single purchase, not a subscription) to a specific course.
Delivery is exclusively digital, via the course portal portal.thalyra.com (operated on the GoHighLevel platform). Login is passwordless via magic-link email. No physical goods are shipped.
Thalyra courses are educational offerings and do not replace medical, cosmetic, or legal professional advice. See section 11 (Disclaimer).
3. Conclusion of contract
The presentation of a course on a brand landing page or on thalyra.com does not constitute a binding offer, but an invitation to order. By completing payment on the Stripe-hosted checkout page, you submit a binding offer to purchase the selected course.
The contract is concluded upon successful payment confirmation by Stripe. You will receive an immediate confirmation and, once your portal access has been set up, a welcome email with access instructions for portal.thalyra.com.
4. Contract language
The languages of the contract are German and English. In case of discrepancies, the German version prevails. We store the contract text and send it to you together with the order confirmation by email.
5. Prices, currency and taxes
Course prices are shown either in Swiss francs (CHF) or euros (EUR), depending on the currency selected at checkout. The actual prices are stored exclusively in our payment system (Stripe) and are shown to you on the checkout page before payment.
CuraCap Schweiz GmbH is currently not subject to Swiss VAT under Art. 10 MWSTG (annual turnover below CHF 100,000). For sales to consumers resident in the EU, different value-added-tax obligations may apply (e.g. the EU One-Stop-Shop scheme for digital services); prices shown are stated as final prices in the selected currency.
6. Payment terms
Payment is processed exclusively via the payment provider Stripe (Stripe Payments Europe, Ltd. / Stripe, Inc.) on a checkout page hosted by Stripe. The purchase price is due upon conclusion of the contract. We do not store any card or account data; this remains exclusively with Stripe.
7. Right of withdrawal for digital content
For consumers resident in Switzerland, Swiss law provides no statutory right of withdrawal for the purchase of digital content.
For consumers resident in the EU, a 14-day right of withdrawal without giving reasons generally applies from the conclusion of the contract, due to the cross-border distance-selling nature of the purchase.
Because Thalyra courses are digital content not supplied on a tangible medium, your right of withdrawal expires early once we have begun performance of the contract (activating your course access in the course portal), provided that you have
- expressly agreed, before performance begins, that we start performing the contract before the withdrawal period has expired, and
- thereby acknowledged that you lose your right of withdrawal by giving this consent.
We obtain this consent during the checkout process before payment is completed (confirmation notice/checkbox on or before the Stripe checkout page). Without this consent, the 14-day right of withdrawal for EU consumers remains in place until the period expires.
To exercise a still-valid right of withdrawal, an unambiguous statement (e.g. email) to info@curacap.biz is sufficient. In the event of a valid withdrawal, we will refund payments already made without undue delay and no later than 14 days, using the original payment method.
8. Usage rights to course content
With your purchase you receive a non-transferable, non-exclusive right to use the course content for your personal, non-commercial use. Reproduction, distribution, making available to the public, or commercial use of the course content requires our express written consent. Sharing your access (magic link, course access) with third parties is not permitted.
9. Your obligations
You undertake to provide correct information when ordering and not to share your course access with third parties. In the event of misuse, we reserve the right to suspend access.
10. Availability
We strive for high availability of thalyra.com and portal.thalyra.com but do not guarantee uninterrupted availability. The course portal is technically operated by HighLevel LLC; maintenance- and update-related outages of the portal are outside our direct control.
11. Disclaimer
Thalyra courses are educational and informational offerings. They do not constitute individual medical, cosmetic, nutritional, or legal advice and do not replace a visit to the relevant professional. We make no warranty as to any particular outcome or result from applying the course content.
The Provider is liable — to the extent permitted by law — only for intent and gross negligence. Liability for damages arising from injury to life, body, or health, as well as mandatory provisions of the Swiss Product Liability Act, remain unaffected.

13. Changes to these terms
We may change these terms. For purchases already completed, the terms in force at the time of purchase apply. The version published on this page at any given time is authoritative.
14. Governing law and jurisdiction
Swiss law applies, excluding conflict-of-law rules and excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes arising from or in connection with the contractual relationship is the registered seat of CuraCap Schweiz GmbH (Canton of Solothurn, Switzerland). Mandatory statutory consumer-protection and jurisdiction provisions at your habitual residence (in particular for consumers resident in the EU) remain unaffected.
15. Severability
Should any provision of these terms be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that comes as close as possible to the economic purpose of the invalid provision.
